The record in this case is quite voluminous, and I will not attempt .to do more than state the general nature of the action and the conclusion at which we have arrived.

*265There was a railroad in the State of Texas, organized and existing under the laws of that State, known as the Houston and Texas Central Railroad Company, which is designated in the complaint as Company Ho. 1.
