delivered the opinion of the court:

This is a proceeding brought by the city of Chicago against plaintiff in error in the municipal court of Chicago for the recovery of a penalty for the violation of the “smoke ordinance.” Trial was had before a jury and judgment and verdict rendered for $300 and costs. The plaintiff in error moved for a new trial, which the court overruled.
