This is a proceeding in

quo warranto,

questioning the legality of the annexation of certain territory to the city of Los Angeles. The appeal is taken by plaintiff from a judgment entered against him after declining to amend upon demurrer sustained to his complaint, and the only question is as to the correctness of the order sustaining the demurrer.
