This cause was tried before a jury and a verdict was returned for the plaintiff on September 27, 1907. Judgment was entered upon the verdict by the clerk on the same day. The defendant’s motion for a new trial was denied November 9, 1907. The judgment from which the appeal is sought was signed by the judge and filed in the office of the *303clerk on December 9, 1907.
