DAVIDSON, Presiding Judge.

Appellant was convicted for violating the local option law, his punishment being assessed at a fine of $60 and thirty days imprisonment in the county jail.

The allegation in the information is that appellant sold to Leroy Thomason. Thomason testified that on the 11th of December, 1910, he was in Mr.
