Tbis is a case in wbicb tbe defendant is summoned to show cause wby be should not be punished for contempt for arresting a juror of tbis court while engaged in the trial of a case. At tbe particular time tbe court was in recess at noon, and the juror was permitted to return to the court at the end of the noon recess, and serve on tbe jury.
