This action was commenced by the defendant in error against the plaintiffs in error to recover the sum of $5,000 claimed to be due as his part of a fee in á divorce suit collected and appropriated by them. There was a trial to the court and a jury, and a verdict returned for the plaintiff in the sum of $3,774.
