This was a suit by tlie appellees, H. L. McDowell and J. E. Burton, filed in tlie district court of Shelby county against the Texas & Pacific Railway Company and its receivers, and also against the Gulf, Colorado & Santa E6 Railroad Company; the purpose of the suit being to recover damages to a shipment of cattle from Waldo, Ark., to Timpson, Tex.
