Appellee First State Bank commenced this action in the Starke Circuit Court against the appellant, Railroad School Township, et al., based *359upon the execution and delivery of an alleged promissory note which was unpaid, subsequently filing an amended complaint. To the amended complaint a demurrer by appellant was properly overruled.
