—Appellant was convicted of felony embezzlement in the Criminal District Court of Harris County, "and his punishment fixed at two years in the penitentiary.

Appellant was a real estate agent and from the evidence negotiated for the purchase of certain real property in the city of Houston, acting in the capacity of agent for one Smith.
