Kiley, J. (dissenting):

Fred Spaulding and Katherine W. Spaulding referred to in the record in this proceeding are husband and wife. The decedent, Lucy A. Weed, was the mother of Katherine W. Spaulding aforesaid, and it follows that Fred Spaulding was the son-in-law of said decedent.
