This is an appeal from a judgment entered in the Saratoga county clerk’s office June 2, 1922, against the defendant for $1,617.59.

The action is for negligence. The plaintiff clainis that on the 26th day of April, 1919, he was negligently run down on Park avenue at Sixty-fifth street in the city of New York by defendant’s chauffeur and seriously injured.
