Defendant in error, Edwin O. Partington, brought suit in the Comm on Pleas Court for a divorce from plaintiff in error, Q-raee Partington, upon the grounds of cruelty and gross neglect of duty, and also sought the custody of the minor child of the parties. This child was about two years of age when the case was heard.
