William J. Schmidt died testate on December 7, 1922, leaving a wife, Ettie Schmidt, to *Page 526 whom by his will he gave all of his property. His estate, real and personal, was entirely his separate property. He left no issue, no father, no mother, but left brothers and sisters and the issue of a deceased sister. One of the brothers has since died, leaving children.
