Prior to December 20, 1923, the plaintiff, Cline Cola Beverage Company, a corporation, with its plant at Mount Hope, Fayette County, was engaged in the manufacture and sale of ice, ice cream, and pop, and also in the sale of a near-beer beverage which it purchased from the George Wiedemann Company, of Newport, Kentucky.
