Charles Kokeseh sued the Excelsior Powder Manufacturing Company to recover damages for personal injuries which he claimed to have' sustained as a result of negligence on its part. The accident happened on April 21, 1924. For nine or ten years prior to that time the plaintiff had worked for the company.
