Appellant was indicted and tried for the offense of murder in the first degree. She was convicted of the offense of assault with intent to murder. Her sentence was fixed at imprisonment in the penitentiary for a term of not less than two years nor more than two years and one month. Code 1923, §§ 3303, 5268.
