The defendant in error, Mary Rogers, was serving as a petit juror in Hamilton county on October 23,1923. When she was dismissed

for the day, the operation of the elevators in the court house, because of the lateness of the hour, had been discontinued and she was obliged to walk down the steps. While descending the steps, she fell, fracturing her hip.
