This is a motion for summary judgment in an action brought by plaintiffs against the defendant to recover the sum of $375 as rent for the months of January, February, March, April, and May, 1930, on the theory that a prior action between the same parties for rent for the month of December, 1929, had been decided in favor of the plaintiffs and against the defendant.
