GARDNER, J.

The opinion of the Court of Appeals discloses the suit as one upon a bond executed pursuant to the provisions of Section 10115, Code 1923, upon appointment of a receiver, and reference made to the succeeding section 10116, giving a right of action upon such bond to any person damaged by such appointment should the same be vacated or discharged.
