CARPENTER, J.

This action was brought by the widow of Terrence Riley to recover for his death caused as -the result of being struck by the defendant’s truck. Upon the trial of the case the jury returned a verdict for the plaintiff in the sum of $5,000.00. The plaintiff thereupon filed a motion for a new trial, asking that a new trial be granted solely upon the question of damages.
