BAUGH, Justice.

Otto Aschenbeck is the adopted son of George Aschenbeck and wife, Frieda Aschen-foeck. Frieda Aschenbeck died on January 27, 1931. Her husband offered for probate her will, alleged to have been lost, stolen, or destroyed, probate of which was contested by Otto Aschenbeck and denied by the county *327court of Lee county.
