The plaintiff-appellee, James L. Yates, Jr., whs an employee of James L. Humphrey, Jr., who conducted a produce plant in the town of Humeston in Wayne county. On the 21st day of November, 1932, Yates during working hours went across the street from the plant to get a jug of water for the use of the employees in the produce plant.
