Hargroves was convicted of tbe offense of murder. His motion for new trial was overruled, and he excepted.

No exception pendente lite was taken to the ruling of the court on the challenge to the array of jurors, but this ruling was. assigned as error in the motion for new trial and in the bill of exceptions.
