ELLISON, J.

The appellant was convicted of robbery in the first degree by means of a dangerous and deadly weapon, in the Circuit Court of the City of St. Louis. He was charged under the Habitual Criminal Statute, Section 4461, Revised Statutes 1929, and the jury assessed bis punishment at imprisonment in the penitentiary for life. On this appeal be brings up only the record proper.
