delivered the opinion of the court:

The commissioners of DeLand Special Drainage District in the county of Piatt in this State made a levy against the lands of the district for improvements of the open drains. The commissioners filed a special assessment roll and assessed the lands which it was alleged would receive benefits from the improvement.
