Gertrude Brown filed in the circuit court of Cook county a complaint seeking to compel Bernard A. Jacobs to perform a contract for the sale of real estate entered into between the parties June 17, 1937. Jacobs filed a motion to strike the complaint from the files and to dismiss the cause for want of equity. The motion was overruled.
