DAVIDSON, Judge.

Murder is the offense; the punishment, fifty years’ confinement in the State penitentiary.

That appellant’s two sons; Lorenzo, age twenty-four, and Odell, age eighteen, by their joint, as well as several, attack, killed the deceased, Ollie Smith, without justification or excuse, is not seriously disputed.
