Plaintiff, as receiver of Shef’s No. 1, Inc., an insolvent corporation, instituted this action to recover the sum of $271.60 upon the ground that the sum sued for constituted an unlawful and preferential payment made to defendant by the insolvent corporation.

After the cause was at issue, it was tried to the court upon an agreed statement of facts.
