DAWKINS, District Judge.

This is a suit to recover principal, interest and penalties of taxes assessed under Title IX of the Social Security Act, 42 U.S.C.A. § 1101 et seq., paid under protest. The facts have been stipulated and from them it appears that the plaintiff, appellant, was organized under Chapter 20, Title 78 of the R.S. of Texas of 1925, Vernon’s Ann.Civ.St. art. 5024 et seq.
