Plaintiff sued in tort, under the first paragraph of section 29 of the Workmen’s Compensation Act, to recover $350 paid to one of its employees as a lump sum settlement for injuries sustained by him in the elevator of a building maintained and operated by defendants as trustees, in which plaintiff was a lessee.
