This action was brought by Seitz, plaintiff, against defendants, L. L. Largent and wife, to recover specific real estate and to cancel resale tax deed.

Both plaintiff and the defendant Largent claim ownership of the land, the latter being in possession.

Upon jury waiver the cause was tried to the court.
