This is an action seeking a writ of mandamus, filed in this court on October 25, 1941, against the Industrial Commission of Ohio.

It is alleged that in October, 1930, relator was employed in Zanesville by one who had paid premiums to the insurance fund, and that while in the course of and arising out of his employment, he was cranking a gasoline motor which backfired,
