LEDERLE, District Judge.

This is a common law action for damages for personal injuries received by plaintiff, Dale Alexander, in a fall on the steps of a hotel operated by defendant, Lyle Creel, at Coldwater, Michigan, while plaintiff was a guest there. Plaintiff is a citizen of Indiana, where he now resides and is employed. Defendant is a citizen of Michigan.
