BARKSDALE, District Judge.

In November, 1941, an indictment, containing three counts, was returned in this court against Richard Vidaver and another, charging in the first two counts violations of the Mail Fraud Statute, 18 U.S.C.A. § 338, and in the third count, a violation of the Securities Act of 1933, 15 U.S.C.A. § 77q (a) (1).
