Plaintiff instituted an action under the Declaratory Judgment Act, Ill. Rev. Stat. 1949, State Bar Ass’n Ed., ch. 110, par. 181.1 [Jones Ill. Stats. Ann. 104.057 (1)], seeking to nullify an automobile insurance policy on the ground of misrepresentation by the insured of the ownership of the automobile.
