The plaintiff C. C. Capps, doing business as “C & C Drilling Company”, filed this action in the District Court of Brazos County, Texas, to recover damages from the defendant General Accident Fire & Life Assurance Corp., Ltd., alleging a wrongful failure to issue a policy of workmen’s compensation insurance to the plaintiff as an employer.
