Per Curiam.

On June 23, 1952, the respondent served upon the appellants and on the following day, June 24, 1952, filed in the office of the clerk of this court a written motion to dismiss the appeal herein upon the grounds that no transcript on appeal nor brief on appeal had been served or' filed by appellants within the time prescribed by rule of this court and that the time for filing and
