Defendant, Jerry Sherman Sage, was indicted by a Federal Grand Jury in this district for violation of the Universal Military Training and Service Act, 50 U.S.C.A.Appendix, § 462. The defendant entered a plea of not guilty and waived his right to trial by jury in the manner prescribed in Rule 23(a), Fed.Rules Crim.Proc. 18 U.S.C.A.
