This case was before this court on appeal from a decree sustaining demurrers of the respondents (appellees here) to the bill of complaint. The decree of the lower court on the former appeal was reversed, a decree rendered and the cause remanded. Smith v. Holloway, 259 Ala. 393, 66 So.2d 877.
