This is an appeal from a decree on a bill and cross bill praying for a declaratory judgment. The import of the allegations is that respondent, Water Works Board of the City of Mobile, is a public corporation organized under §§ 394 — 402, Title 37, Code 1940, and that it has constructed in the County of Mobile a large lake for the purpose of providing water for its customers;
