The government moves for summary judgment. The suit is one to recapture subsidy payments made by the Reconstruction Finance Corporation to the defendant under the provisions of the Emergency Price Control Act of 1942, as amended, 50 U.S.C.A.Appendix, § 902 (e), and the pertinent regulations promulgated thereunder.
