This matter comes before the court upon a petition for a writ of habeas corpus.

Emil McCord is being held to answer for statutory rape. It is charged that he, being a male person 23 years of age, did carnally know and abuse a female person under the age of- 16 years, to wit, 14 years of age. Andrew Nicka-norka is held to answer on the same charge.
