In this action the plaintiff seeks a declaratory judgment as to his status under the immigration laws. More specifically, he seeks a declaration that his application for suspension of deportation is governed by the provisions of 8 U.S.C.A. § 1254(a) (1) 1 *and a determination of “his right to seek cancellation of deportation upon the facts of his case.
