delivered the opinion of the Court.

Wofford was indicted on a two count indictment, charging (1) forgery and (2) uttering a forged check. He was found guilty under the second count and sentenced to three (3) years in the State penitentiary, from which judgment he has perfected an appeal, filed briefs and able argument have been heard.
