This is a petition for a declaratory judgment. Jurisdiction of this Court is invoked on the basis of diversity of citizenship of the parties and the requisite jurisdictional amount. The plaintiff, Harry L. Kozol, is a resident of Newton, Massachusetts, and at all material times is and was a doctor of medicine duly licensed and actively engaged in the practice thereof.
