It was shown by the state’s evidence that on the night of May 4, 1960, as highway patrolmen Ray Curtis and Don Keller were traveling on U. S. Highway 81 near Gar-dendaje in LaSalle Cpunty they observed a Pontiac automobile parked on the highway with the lights off.
