Plaintiff brought suit for recovery of workmen’s compensation benefits as for total, permanent disability plus penalties and attorneys’ fees.

With respect to disability, plaintiff’s petition alleged that he was injured on November 14, 1960, while employed as a pulpwood cutter, when a tree fell and struck him across the shoulders and back.
