The defendant has appealed from a judgment accepting a referee’s report and granting the plaintiff a divorce on the ground of intolerable cruelty. The .defendant asserts three errors by the court in accepting the referee’s report. The basic one is his claim that the court lacked jurisdiction to entertain the action.
