Opinion and order, December 21, 1965: The appellant was tried on an information charging him with aiding or assisting in setting up or promoting a lottery, a felony; and with possession of lottery paraphernalia, a misdemeanor. The trial court found the appellant innnocent under the first count of the information, but adjudicated him guilty on the second count.
